A veteran senator on Thursday assailed the Duterte administration’s inaction on the implementing rules and regulations (IRR) for a law that gives tax breaks and discount on goods on persons with disabilities (PWD).
In a statement, Senator Ralph Recto of Liberal Party (LP) said the Republic Act 10754 was signed into law by then President Benigno Simeon Cojuangco Aquino 3rd on March 23, but no IRR until now.
The multi-agency—Department of Social Welfare and Development (DSWD), Department of Finance (DOF), Department of Health (DOH), and the National Council on Disability Affairs (NCDA)—tasked to formulate the IRR has not done the IRR, Recto said.
He noted that the DSWD, DOF, DOH, and the NCDA under the Aquino administration failed to do its legal duty to come up with the IRR.
Worse, Recto said the aforementioned departments and agency in the executive branch continue to disregard the IRR.
Because of this, the RA 10754 could not be implemented, he pointed out.
The head agency in writing the RA 10754’s IRR is DSWD presently headed by Secretary Judy Taguiwalo.
Recto emphasized that the IRR is extremely important so that the law could be implemented.
Once implemented, the PWDs would get discounts on goods and tax breaks.
Recto is hoping that the inaction of the DSWD, DOF, DOH, and NCDA under the present administration is not a deliberate act to repeal all tax discounts intended for the PWDs.
The supposed repeal of tax discounts on PWDs was reportedly part of DOF’s tax reform agenda that it submitted to the Congress for approval.
The tax reform has the support of the World Bank.
Recto urged DSWD, DOF, DOH, and NCDA to produce the IRR before the year ends.
He said the IRR is the “missing link” for the full implementation of the RA 10754.
